Aris case before CAS dismissed

CAS has dimissed the latest appeal by Aris Thessaloniki before the CAS. here is the press release from CAS:

Lausanne, 26 August 2005 – The Court of Arbitration for Sport (CAS) dismissed today the second appeal filed by the Greek football club FC Aris Thessaloniki against FIFA in relation to a dispute involving another Greek club, New Panionios NFC. The CAS had already dismissed a first appeal filed by FC Aris on 15 July 2005.

The facts related to this matter extend back to November 2004 when the FIFA Dispute Resolution Chamber upheld a monetary claim filed by two Players against Panionios. Considering that Panionios did not pay the requested amounts to the Players, the FIFA Disciplinary Committee decided on 14 February 2005 to grant Panionios a final period of grace of thirty days for the payment of the outstanding amounts and also ruled that if such payments were not made within this time limit, 12 points (6 for each case) would be deducted from the points obtained by Panionios in the A Division of the Greek Football League. Panionios paid the amounts due to the Players but only after the expiration of the time limit fixed by the FIFA Disciplinary Committee. However, no points were deducted from Panionios’ first team. Thereafter, the FC Aris, which was ranked 14th in the Greek Championship with 25 points and was relegated in second division while Panionios finished 11th with 35 points, filed a complaint with FIFA. On 6 June 2005, the FIFA replied that the execution of a decision taken by a FIFA body fell under the competence of the relevant member association, namely the Hellenic Football Federation.

On 15 July 2005, CAS dismissed the first appeal of FC Aris considering that FIFA had no authority to proceed with the deduction of points from Panionios’ first team. Further to this CAS ruling, FC Aris filed a new appeal on 28 July 2005. The second appeal was dismissed by CAS today. The reasons for such decision will be communicated by the Tribunal in a few days.
